I have a tenant who is receiving LHA she got into arrears and I had the Council pay me direct. I received one payment from the council before the tenants claim was suspended.
The Council requires information from the Tenant to continue her LHA payments so far she has refused and I'm left with the rent arrears increasing.
I've issued her a Section 21 to evict her on the 18th Aug but the council tells me she is entitled to start a new LHA claim with a new landlord when she moves yet I'm not entitled to any back pay because she refuses to submit the information required now for my rent?
If LHA wasn't unfair already to Landlords this ruling is absolutely absurd? Is the council correct in what they say, if so this is the final nail in the coffin for tenants on LHA wishing to rent from me!!
