We have had tenants who over last three years had missed rent payments claiming  an issue with santander and smile. She has sent  messages to us telling us that Santander have claimed responsibility and would be refunding the money, Santander have blamed Smile and lastly that she has had legal advice saying that we have had the money 
For last few months in the tenancy she refused to pay stating that she didnt trust us. On March 1st she left property, owing over 5k and a house that has thousands of pounds worth of damage (insurance wont pay out as say its malicious damage, police say its a civil matter. We made several attempts over last year to carry out an inspection but on day there would  be an  excuse on why we couldnt attend)
We contacted the banks during their tenancy and every time the banks were unwilling to discuss anything with us but Smile did inform us that they were not holding any money and confirming that no money from her had entered our account.
we took print outs of the messages the issues to Santander where they confirmed that they would not have sent messages of such kind 

We have had tens of letters to house now from companies they owe money to  so with that and fact that she wont tell us where she has moved to we think maybe  using a solicitor may result in us throwing even more money away 

Please help!
