Unfair penalty charges by banks.....and possible implications for landlords

Just chewing over this current debate where the OFT (office of Fair Trading) have 'ruled' that any penalties that banks charge their customers for going overdrawn/exceeding overdraft limit/bounced cheques etc, can only be justified by the actual 'cost incurred'. This may have implications for landlords where their contracts provide for penalty payments for late payments. Any thoughts?
