Due to a strange set of circumstances - all my own fault - not only have I registered a deposit late, I registered it a couple of days after the tenancy had ended. It wasn't entirely clear at the time that the tenancy had ended. It was registered with the Deposit Protection Service. This was 9 months ago and the former tenant has now brought a county court case for the return of the remaining deposit (we are in dispute) plus 3 x the original deposit.

I am aware of the cases which indicate that if deposits are protected before a claim is made, then the 3 x original deposit compensation is likely to be not payable, but do these apply if the deposit was protected after the tenancy ended?
