Agent will not refund tenants deposits

That's my problem! I fear that she has spent the deposits as she has made several promises to repay, but no cash has materialized. That is why I/my tenants need to claim form the insurer.
I thought that the point of the insurance was to cover the tenant in case of unwarranted loss of deposit. Is this not the case?
