deposit paid in after 14 days

please advise..

If a deposit is paid into a scheme after 14 days of receiving the deposit from tenants is the landlord still liable to pay the fine of 3 times deposit if the tenants wish to take the matter further?
once paid into the scheme is there anything the tenants can do about it?
