advance rent should now be registered as a deposit in deposit scheme!

This is the advice given by Dave Absolom, the RLA legal adviser, in answer to a previous deposit query (I'm highlighting this to raise awareness as there is no other advice on this website on this issue, this will surely mean that the rla tenancy agreement needs changing)...

"The courts are starting to challenge the advice that was on the communities.gov.website that advance rent is not a deposit.
In view of that members are advised to place advance rent on deposit.
You should also try to protect the deposit with the custodial scheme as until you do then the tenant can sue for 3 times its return"

I asked for clarification on this and that was Dave's response. Seems impossible to comply with to me.
