Hello,

Here's the situation. I have two properties.

Property one - A tenant moved in Dec 2010, signed a 6 month AST and the deposit was paid into the DPS. A new 6 month AST was signed in June 2011 and again in Dec 2011. The tenant would like to sign another new one in June 2012.

Property two - A tenant moved in Dec 2009, signed a 6 month AST and the deposit was paid into the DPS. They since signed a couple more AST's but both us and the tenant are now happy not to sign a new one and take it month by month although last time I saw her a couple of weeks ago that she told me that she would like to sign a new AST soon and she will contact me shortly which I'm happy for her to do.

Obviously the deposit for both tenants are still held by the DPS and both tenants are aware of this when they moved into the properties but I did not give them the prescibed information at the time. (The detailed statement regarding the deposit and the explanatory leaflet which each scheme issues for the tenant.)

So my questions are:-

Do I have to give this prescribed information to both tenants by 5th May 2012?
Or can this be done when/if they sign a new AST?
