Tenancy deposit dispute before TDS

We have recently had a tenant move out of a property ( Pre TDS ) where we hold the deposit as agents
The carpets have fair wear and tear but the Landlrd disagree's and wishes to take the full deposit as replacement of the carpet ( deposit is £433.00 new carpets are £450.00 )- The tenant has been in the property for over 2 and a half years and the carpets were around 6 months old when he took the tenancy.
The tenant will now be contacting a solicitor - howver the landlord wishes to dispute against us for not releasing the bond to them.
Are we right to hold the deposit in our account until the matter is resolved ?
