Deposit on Rent Income of £39k pa

There had been some talk recently over changes of the way deposit was handled for rental income over £30k pa. In the precious years we have held the deposit. Please can you advise if the landlord can still hold the deposit if the rental income is £39k pa or do we need to pass it to DPS? Thanks
