Dear Sir

I had a horrible tenant where at the end of the tenancy according to check out report broke and few items missing total value around 900£. Sort of threatened the management that he would take his photos to the court if the dep is not paid in full and not sure what happened the agents have released the dep. Anyway this tenant has gone to court with some other issue and at the hearing the judge said I cant sue him for the things he's broken since his dep has been returned by the agents and that I must ask the agent to return the dep. Is this true? Why cant I sue that tenant for the mess he has created. The judge said once the dep is returned there's not much you can do.
