Are renewal fees, where the agency does nothing at all, legal in impetuity? I have what seems fairly common situation where the tenants wish to stay, the initial agency who found them is not managing the property, but claim that as long as the tenants stay on, they can claim the 10%.

What is the situation if I get a neighbouring agency (who is offering fairer T&Cs) to let the property, and the current tenants decide to apply via the second agency? Am I liable for potential double fees? If so such a situation would seem to effectively unfairly penalising tenants who are looking for somewhere to live as I would have to tell the new agency that the current tenants cannot be considered.
