Lanlord Error in section 8 served

My Tenant who is difficult was served a section 8, grounds 8 &12. In fact after 2days of studying the RLA website and going through statements. The tenant should have been served grounds 10 &12 (Tenant owes the shortfall of 3months rent) the tenant has continued to be a nuisance to the neighbours and has been arressted and remanded as he has broken bail and was verbally violent to the neighbour below the flat where tenant is living. Can I still go ahead with a possession order N5 &N119?
