A tenant owes me money and I have previously been advised to issue him with a summons. He is not disputing the claim, has had the housing beefit but spent it.
Question is, if he is not disputing the amount owed how does it help me by issuing him with a summons. What if he still does not pay, what legal recourse do I have? What are the timescales? I think he also owes money to other people as debt collectors have left cards for him.
The only asset I think he has is a car. Can I get debt collectors to possess it and sell it to repay my money?
Can any action be taken by a council if they have paid housing b to him but he has not passed it on. Any future payments are to be paid direct to me but he is due to leave on 26 Jan anyway which is another complication.
