My tenants tenancy agreement starts from the 1st of October 2006 and expires on the 31st March 2007. There are 3 tenants in a joint tenancy. Two the tenants are employed and but the third who used to be employed has decided to stop working, is now on housing benefits. The third tenant who is a heavy smoker is not getting along with the other two. We have verbally told her to move with two months notice but she refuse and now have reported us to the housing authorities that we are harrasing her.

Can we issue a section 21 on March 1st and take possesion of the property May 1st? and keep the other two good tenants?
