I have non-smoking clause within the tenancy agreement. Tenant has smoked during the term. In my experience prospective tenants will reject such a property if they are non-smokers. The damage can be outlined as follows:

1. soft furnishing - replacement

2. redecoration to include stain blocking - nicotine will travel through emulsion or even eggshell unless blocked.

The tenant says that he cannot smell the nicotine and denies that it causes damage and that he has smoked lightly.

I photographed a full ashtray during an inspection.

If I have to substantiate my claim in the county court what evidence can I provide. i.e 1. Are there test kits for nicotine testing? 2. Specialist surveyors that can certify. 3. Information that may be provided to the district judge from other authoritative sources?
