We have given a tenant two months notice which is due to expire on 21/7/07. We have received a letter from the Council to say that if he is seeking to be re housed by the council he will not be moving out on expiry of the notice.

We do not normally take Housing Benefit tenants so have not come across this before, this particular tenant was not on housing benefit when we first let the property to him but he subsequently lost his job and made a claim on housing benefit.

They have advised us that we cannot evict him without a court order and bailiffs warrant. If we need to do this, can you advise what action we need to take.
