HMO Licencing, do I need it if one tenant has his main residence some where else?

We have an argument with a Council who is prosecuting me for having (effectively)delayed applying for a Licence when I took on a 5fth tenant, who had his Residence in another City.
They argue that as this person spends more time here (on a job), his residence in here, therefore I needed a licence.
Furthermore, I have I licence but they still prosecuting me for not having it over a period of 3 months.
Has any one got experience in this matter.
