I hope you can help please, the situation is this: -

My TA states that my tenants must give me two months calander notice to expire on a *rent payment day*.

My TA is dated the 23rd of each month, and I have been given notice today, the 31st October.

My Tenant has always paid me around the 3rd/4th of every month because of his salary.

My Tenant is stating that because he pays me on the 3rd/4th of every month, he therefore can techcially give me notice on the date which he pays me, ie today the 31st, not the TA date of the 23rd of every month, therefore giving me notice on the 22nd of the month for two calander months.

I just wanted to clarify please, if he is actually correct and I would be wrong to hold him to a notice peroid until the 22nd January 2012, which it would in effect be two months from the 22nd November 2011.

I hope this makes sense?
