Commercial Lease

I have acquired a shop with living accommodation which is on an agreement from 29th sept 2002 to 28th sept 2005 it was assigned to the current occupant on 19th sept 2003.

The tenant has arrears and has been offered a new lease but has not signed a new agreement, can I simply send a licensed bailiff in to take possession or do I have to apply to the courts
