deposit & failure to move in

Hi,

I tried to call but your lines are down.

I had a tennant sign the holding deposit form to secure my house that was up for let. on the day the couple were due to move in they never showed up & didn't even have the courtesy of calling.

The next day the girl rang & said that she had split from her boyfriend & they were no longer moving in together and that she looked forward to receiving her £600 deposit back.

We have refused to give it back as it is over 14 days since they initially signed the holding deposit form and they have not moved in.

They are threatening legal action.

Can we withold the deposit given that they failed to move in? Please help.
