No AST when claiming LHA, payment then direct to landlord ???

I would not consider this. But

If a tenant is taken on without issuing an AST and the tenant is claiming LHA. Does the council have to pay the landlord direct as no AST has been issued. ?

I did a viewing today and the proposed tenant told me this is how she is with her existing landlord.

Is this a loop hole a landlord has taken and why would he/she not issue a AST
