Tenant Employment

Out tenant has told us he is employed and this is what we have told the insurance company but we find out from a third party that he is not employed and is indeed on benefits. The question is am I legally allowed to ask him his employment status and if he is on benefits and what type of benefit? I do not want to get into problems with the insurance company
