HI
Horrible problem that has been going on for sometime.
I own a ground floor flat. My tenants bedroom ceiling is directly underneath the above patio, owned by upstairs.
I am convinced this is the cause of water ingressing into the bedroom ceiling everytime it rains and running down the walls.
Question is it it my responsability as my roof or upstairs responsability as their patio?
If it were my responsability I would make it into a proper roof with tiles etc and not allow people to walk on it. Or is it his responsability as he uses it as a patio.

We jointly own the freehold between the three flats in the block

Can I put a land charge on his property to get him to fix it as it's constantly causing damage to mine?

Any thoughts greatly appreciated.
