HMO rule?

Hi Guys

I have a 4 bed extended semi that i rent out to a company (they house 3 people with learning difficulties)

The house manager is trying to state my property is a HMO because it has 3 people not related.

However, i believe its not a HMO because its not 3 floors or more.

who is correct?
