I have a prospective tenant looking to take up residency in about 4/5 week's time.
I would prefer to let the property sooner but I wonder if it's advisable to enter into an AST with the applicant now where residency will not commence for 4 or 5 weeks and withdraw the property from the market? If the applicant withdraws from the agreement before taking possession of the property, can I enforce the terms of the contract or would I be laughed out of court?
I appreciate I would have a duty to find an alternative tenant as soon as possible.
