My Father in Law, who has now passed away, failed to issue a Section 20 Notice prior to 28th Feb 1997 to change a tenancy from an Asuured Tenancy to a AST. The current tenants who moved in in 1994 and would actually like the tenacy to become a AST because they want us to give them an eviction notice because (they have three young children) they want to get a Council flat.

They have suggested we produce a Section 20 Notice now (if the forms still exist?) and backdate it to Feb 1997. My question is whether such action is lawful & ,if not. is there any other way we can alter their current tenancy into an AST?
