Polystyrene Celing Tiles

In a rented poperty is it illegal to have the old polystyrene celing tiles. I understand that if they are not on the kitchen ceiling then it is ok.

Now a contractor has told me he believes that in a rented house you cannot have polystyrene celing tiles anywhere.

Anyone know the correct answer on what is legal or not legal.
