An interesting one for you.

I own a flat where the management company is Ballymore. There is a central hot water supply system with a large boiler in the main building that also provides heating in the flat.

Recently, they out-sourced this operation to a company called EnerG who are suddenly charging high rates for energy and charging all sorts of fees around energy supply.

My tenant is refsing to pay the energy charges as she says that the meter is incorrect. Ballymore say that this is an issue for EnerG and EnerG say that it is a matter for Ballymore.

Now, my contract clearly allows all of these costs to be passed on to the tenant and I can withold deposit monies to cover this, but the tenant will then take that to arbitration.

Any idea what the tenancy holding arbitration scheme will want to see to rule in my favour?
