I have just received a letter from my local council informing me that they are about to reclaim £1700 due to an overpayment of rent benefit made to one of my tenants, but paid to me directly.

The tenant left the premises in September 2008 and I informed the council at that time so that they didn't overpay me.

It transpires that the tenant was not due benefit between 2007 and 2008 after a re-calculaion and it takes the council one whole year to discover this fact and instead of chasing the tenant for the funds they are chasing me.

As it was the tenant left me with rent arrears as the benefit didn't pay the full rent anyway and the clean up costs came to a couple of thousand. And now this.
Any thoughts on how I should proceed.
