Condensation pipe fitted into down pipe

I rent out a semi. Unfortunately i need a new combi boiler installed and my plumber said it would be easier to put a new condensation pipe into the down pipe. However, the drain pipe is about 10cm on my neighbours property even though the guttering form both properties goes into this central drain pipe. My neighbour will not give consent for a condensation pipe to be fitted onto the drain pipe. Is she within her right not to consent? or because rain water from my guttering does into the down pipe should give me equal access (for a better term) and therefore i am within my right to fit a condensation pipe into it.
