We have just been reding some information on a court case for section 21 notice and the possession was refused on the basis that the tenancy had changed to a periodic and the deposit was not re-deposited. Could you clarify the situation as we have asked the DPS the same question previously and they confirmed that we do not need to re-deposit under this basis. We basically need to know if a tenancy turns into a periodic do i need to request the deposit back and then resubmit. any clarification would be great.
