Hi,

The property is in the hands of agents and they notified me back in September that the tenant had advised them that the neighbour had driven into a fence panel and knocked it down. In November the agent advised me that the neighbour had agreed to pay. They said they would arrange the repair. I have now been contacted by the agent and told the fence had not yet been repaired and that they cannot get a response from the neighbour and that I should repair the fence at my own cost and for me to pursue the neighbour.

How do I stand ? I said I would claim from the deposit but the agent said the deposit did not cover 3rd party damage.? If this is the case if the tenant were to have a party and the party goers trashed the property would that be my responsibility as it is third party damage?

Thanks for any advice
