i had taken a deposit before 2007 law. I did not at the time know it applied to before 2007. However; now I have protected it but cannot return it to tenant as its in a costodial scheme with TDS and they say the tenant has to agree for them to return it but the tenant does not agree because he thinks he can get 3 times the deposit if he sues. i want theis scenario off my back. Can I go to court and say this has happened and how much should i pay the tenant and if so what are the forms and procedure. the reason i want this done soon is because i dont want a tenant suing me while i am away on holiday and i do go away for long periods.
