I have just lodged the forms N5, N119 etc in court. Phew! what a palava. the tenant has been there 10 years. My question is can it go to appeal court if he appeals against the county court decision. From what I remember Superstrike Vs Rodriquez it was the appeal court decision to pay 3 times the deposit. Unlike the superstrike case I had protected the deposit but as the deposit was in 2003 and I protected in 2009 there will be something to pay. However; I did ask DPS at the time and their answer was I did not have to protect if it was a 2003 deposit but I cannot prove it.
