Hi, There is a group of 4 students taking a house all with parents guarantees. The contract requires all the students to be jointly and severally liable therefore each guarantor is also jointly and severally liable. the parents of one student want a limited liablility attached to the guarantee so they cannot be help liable for the entire rent for the whole period of the fixed certain term of 1 year. The agent involves says this cannot be done and is never done that way. the agent says if it went to court all 4 guarantors would have to share the liability. I would prefer the parent to be given a limited liability as requested. Please can you give some guidance.
