Hi, we have a freehold property on a new development in Manchester there is a management company which makes a service charge which they post to the property. Our tenant has in the past passed them on to us to pay, unbeknown to us the tenants had personal problems and stopped passing them on, so two invoices totalling £36.00 where unpaid. The tenants left in August. We were contacted by our lender in October telling us they had a demand for £798.12 made up of administration charges and legal fees. They have contacted our lender to charge it against our mortgage . Can this be legal as we feel they have not made any attempt to contact us directly. Surely they should have sent a recorded delivery to our tenants as they would certainly have contacted us. Hope you can advise us.
