Section 21 notice against a tenant with a very old Tenancy agreement

Hi, I have a tenant that I want to serve a Section 21 notice on to regain the property. The original AST goes back to May 2006 and has just continued on a as a static periodic tenancy, a deposit was taken at the time but not protected as the tenacy was way before the legislation making deposit protection compulsory.

What is the legal position on the deposit issue and what sort of section 21 notice do I serve.
