We are an agent using the DPS to protect deposits, a tenant left a proeprty dirty and the landlord requested the full deposit to help cover damages. The tenant logged into her DPS account without any pressure and agreed to the landlords request. She is now threatening legal action against the landlord for her deposit back (landlord has received teh full deposit from DPS) This is 25 days after vacating. Can the landlord be sued to return the deposit when the tenant agreed its release via the DPS?
