we have a registered HMO which we rent to 4 students under an AST. unbeknown to us one student left and the remaining 3 took on a new tenant. he is not on any agreement, we have no references and no idea who he is. the new tenant is not paying his share of the rent, is smoking in the property and generally abusing the other tenants. He has a key (provided by the other tenants) and is refusing to leave the property. They are now in arrears, but not 2 months. what can we do as landlords? i dont want him there, the others are fine but do we terminate the whole tenancy? dow e have to go to Court or can we just exclude this one person from the property?
