mortgage broker not doing their job

Two months ago we instructed a mortgage broker to arrange a mortgage. After two months and lots of double talk and outright lies we found they only applied to the mortgage company yesterday. Leaving us having incurred solicitors fees etc.
Obviously, we are feeling miffed, but should the deal fall through do we have a claim against the broker?
No real problem here as we have a back up plan and the sale should go through but the forums views would be of interest should it all go wrong!
