A quick question, I think I know but as court fees so high now I will check.

Planning to put S21 in to court on Monday. I have a joint tenancy for a couple, but she left about 8 months ago. They both signed my receipt for S21. And no other AST is in place.

Do I just action for court as if its still a joint tenancy? I assume that will result in a notice of claim being issued, which I think will be enough to get him out.

If he defended it would the fact she has left be a defence that paperwork is wrong?

Thanks
