I would appreciate any advice on the following....
Housing Benefit has been paying our DSS tenant's rent over the last couple of years. The Tenant has advised Housing that she moved out of the property a couple of months back. We are unsure exactly when she moved out as we get minimal response from her(although she still has some of her belongings at the property). The tenant claims that Housing said to her that we would need to refund the two months rent they paid us for the 2 months that she was not at the property, irrespective of whether she still has some of her belongings at the property. We still need to contact Housing and also check the legal aspects regarding the payments, but do you know if the above claim is correct?
Although the TA is between us and the Tenant (which states that rent is payable until vacant possession and key-handover), can we insist to Housing that the rent is still due and we would not be returning the 2 month's rent (assuming she did leave 2 months ago)?
