Dear RLA

We have a tenant who claims that he has a protected tenancy. He had a fixed-term shorthold tenancy in Flat 4 in each of 1986 and 1987 for a year. We have the tenancy agreements, but the Section 52 documents are hard to find. He then moved at his request to Flat 5 on an assured shorthold tenancy. Later in 1991 he moved to Flat 6 on an assured shorthold. He claims that we moved him from flat 4 to flat 6 for maintenance reasons. However, refurbishment was done only after he moved to Flat 5, and he moved to Flat 6 before Flats 4 and 5 were refurbished, but after Flat 6 was completed. He was keen to make the move. This is because the rent officer wishes to fix a fair rent and has asked for documents for 8th September.
