I am letting a property through an agent under a rent collection scheme.

Due to breach of contract and incompetence on behalf of the agent, I have served notice of termination of contract with effect the end of the current tenancy, as my tenant is unwilling to have anything further to do with the Agent.

The tenant wishes to remain and I am happy for this.

There is no provision for renewal in the current tenancy agreement.

Is it lawful to agree an entirely new AST from the date immediately following the end of the current tenancy?

Or must I in some way to recognise that the tenant is already resident at the property and that the agreement is some kind of renewal?
