HI ALL
joust wanted to alert people to this.
we have a large portfolio of over 100 properties and we pay all of our mortgages/bills/service charges /ground rentscouncil taxes etc etc .
the other day we get a call from a tenant ' sorry I've opened some mail by accident and it looks like its court stuff for you "…….we got this letter and to our shock it was a claim for possession of our property………apparently we had not paid 6 x £30 in ground rent
……….on further investigation the letting agent confirmed that they had sent a letter in 2010 to chancery st james saying any correspondence was to their address or our home address…….chimes properties???? are the claimants.
IT LOOKS LIKE THEY HAVE NOT UPDATED THEIR RECORDS FOR OUR ADDRESS……SENT GROUND RENT PAYMENTS TO THE RENTED PROPERTY ……..TENANT HAS NOT FORWARDED……IF WE HAD NOT GOT THE LATEST COURT DOCS FROM THE TENANT (TOTALLY ON RELIANT ON TENANT PASSING THESE COURT DOCS TO US)……..THEN THE PROPERTY COULD HAVE BEEN TAKEN AWAY FROM US ……just got in time to file a defence……..WHY HAVE THEY NOT CONTACTED THE MORTGAGE COMPANY TO ASK FOR PAYMENT ????

WE HAVE CONTACTED OTHER PARTIES SOLICITORS AND SENT THEM THE LETTER DATED 2010 …….i have been advised by someone in the business that this is being done more and more to obtain properties without landlords knowing ….especially if the ground rent details are not being passed on by tenants……in our case we informed chancery of our details and it appears they still send ground rent information to tenants…..we have many tenants who get a lot of post for previous tenants etc and they will ignore it ….HENCE THIS PROBABLE MESS ….ANY ADVICE WOULD BE APPRECIATED
