I am in the process of serving notice to a tenant who has deceived me when entering into an AST ie he took a double room and moved in with his adult son without notifying me when he signed his AST.My problem is I cannot serve him a S 21 because the property is not currently registered as an HMO and it will be very difficult to convince a judge using S 8 without hard evidence of his intention. If I apply for an HMO licence, will I be penalised and fined for not obtaining a licence from the local council before.
