Hello to colleagues with experience of the custodial scheme of MyDeposits. Its all new to me because I only recently started taking deposits, not needing to do so. I bowed to pressure from my Insurers & more stringent terms of my S. Licence.
April of this year issued a 6 months AST to a non-UK family. 3 related adults plus child. Rent/bills paid by highest earner of the trio who paid the Deposit. Recently one adult had to return home to deal with a family crisis. Its uncertain if he will return next year. Meantime full pcm rent must be paid.
To solve financial pressure the lead tnt asked permission to sublet a 3rd bedroom to their childhood friend who was newly arrived in the UK. i would usually treat an incomer as a Permitted Occupier. This wasn't possible in this case so late October I issued a new AST, re-issuing the usual documentation, asking advice about the return of the lead tnts deposit held by MyDeposits.
My email explained all that & asked in the circs was it necessary to return the deposit to the same tnt who'd paid it? I received an unhelpful generic reply that the deposit must be returned.
I've not been able to get a fulsome reply to my repeated query ....that its the same tnt who signed a new AST & I'm not sure that I'd get the deposit back [ given the time of year & lack of work for tradesman].
Time is marching on & I need an answer to my query. Anyone familiar with the MyDeposits custodial scheme that has experienced the same situation?
When all is signed & sealed, I've lost leverage for the repayment of the deposit IF i heed the terse advice to apply for the release of the deposit back to the same tnt who paid it initially.
