We have two tenants in adjoining flats who do not get on. Each tenant has raised a complaint about the other regarding noise issues. We have advised the two tenants to try to speak to air concerns and improve matters - hasn't worked.

We have also advised each party to report noise concerns to the council and record diaries of issues to demonstrate timings, potential tenancy breaches etc..

We have written to all parties concerned explaining their responsibility under their AST not to be anti-social, including noise issues.

We have subsequently received reports of threatening behaviour (both ways) and potential racist elements. We have at this point advised that the aggrieved party involve the police as this is approaching a hate crime.

The question is, have we done everything we can do as landlords to not leave ourselves open to a claim for allowing a nuisance to occur? One tenant believes we are not doing enough to protect quiet enjoyment - I cannot see what else we could reasonably be expected to do.
