I issued my section 21, and have the court order and the 5 weeks the tenant had to move out has now elapsed. My tenant remains at the property and currently has no where to go.

She has been talking to Leeds City Council who tell her she must remain at the property until I instruct Bailiffs. So LCC are complicit in telling her to defy the Court Order.

Further LCC are saying that if she gets a notice from the Bailiffs she should go back to the court and ask for a hearing. Is that possible will the County Court look again at this case when the time she was given to ask for a hearing has long since elapsed.

If the County Court would look at it again am I correct as the original window has now closed to appeal, that there is a substantial fee she would have to pay to do this?

I have given her today and tomorrow to go back to the council before I instruct the bailiffs.

I am aware that I could transfer this case to the High Court for a fee of £71. I have heard that the fees then charged for enforcement to gain possession can vary and be substantial. Can anyone give me any guidance on how much those fees may typically be?
